Waste Material

 

The customer represents and warrants that all materials placed in the rented equipment shall be “waste material,” as defined herein and shall contain no other substances. According to our terms and conditions, “waste material” shall be defined as solid waste generated by the customer, excluding radioactive, volatile, highly flammable, explosive, biomedical, infectious, toxic, or hazardous materials. 


“Hazardous materials” include, but are not limited to, any amount of waste listed or characterized by the United States Environmental Protection Agency or any state agency pursuant to the Resources Conservation and Recovery Act of 1976, as amended or applicable by law. 


Title to and liability for any waste excluded above shall remain with the customer, and the customer expressly agrees to defend, indemnify, and hold harmless the contractor from and against any and all damages, penalties, fines, and liabilities resulting from or arising out of such waste excluded above. 

Restrictions and extra fees apply to the following:  

• Appliances • Propane tanks • Tires

• Mattresses • Refrigerators • Monitors

• Televisions • Air conditioners • Freezers

• Computers


Other prohibited items include, and are not limited to, liquids, solvents, chemicals, Freon, batteries, paint cans (unless dry), biohazards, medical waste, asbestos, lead paint materials, dirt, equipment containing gas/oil, and household garbage.

Charges and Capacity

 

The maximum tonnage included in the package will be present on your service. The weight of the delivery truck and the empty/full equipment is substantial. The customer will provide sufficient access to deliver and retrieve equipment that is inclusive of load bearing capability. 

 

The contractor will not be held responsible for damages to yards, shrubs, fences, or pavement. 

 

Equipment Care

 

The equipment delivered to the customer is property of the contractor, and therefore, the customer is responsible for taking reasonable care of it. Any damage, movement, loss, etc. will be charged to the customer. All claims arising from improper use or allowed access by the customer will be the sole responsibility of the customer, including damages, injuries, wrongful death, suits, penalties, and fines that arise. 

 

It is the responsibility of the customer to ensure that the equipment is secure until it is picked up by the vendor. Leaving a site unattended does not excuse liability or charges for contamination or overages. 

Driveways and Parking Areas

 

The customer warrants that any access/location provided for the contractor’s equipment is sufficient to bear the weight of all equipment and vehicles required to perform the service. The contractor shall not be responsible for damage to any pavement, accompanying subsurface, or route reasonably necessary to perform the services herein contracted. 

 

The contractor shall not be responsible for damage to utilities. The contractor can supply wood planks to be placed under the container to protect the pavement for an additional charge of $25.
